Am I entitled to severance that my company is offering laid off employees even though I am out on disability?

I am out of work on short term disability that will eventually be long term (Parkinson’s Disease)
I have worked their 37 years. My company is giving severance to all other employees that are being terminated. They are not offering to me because I am out on disability. Are they legally justified in denying me the severance package?

This may be a bit off topic, but given that you worked there for 37 years and have not described the work area or any history, it would be worth talking to a workers compensation attorney as well.

Most people think of WC as about people falling off of ladders. However, there does not have to be a trauma, if could be environmental factors, like metals, solvents or pesticides. It could be a worsening of a non work condition.

It can also be something that happens over time. The long period of service would make you make you a good Claimant. It is certainly worth discussing for a deeper dive.

WC is contingent and the consults are free so there is nothing to really lose by having someone do an intake.
